The Guideline lays down the rules and procedures for the leasing of undivided agricultural land. The Guideline is composed of the following sections: Objects and parties in the process (I), Procedures to be followed by the Commission responsible for the leasing of undivided agricultural lands (II), Procedures to be followed in cases when the Ministry of Agriculture serves as the leasing authority (III), Timeframes for leasing undivided agricultural land (IV) and Final provisions (V).

This Regional Law regulates relations in the sphere of soil conservation, improvement and rational management of agricultural land in the process of economic activities. The scope of this Regional Law shall be to ensure soil improvement of agricultural land. Each plot of agricultural land shall be issued soil fertility certificate in accordance with soil, agrochemical, phytosanitary, ecological and toxicological analysis and it shall be transferred to owners, tenants and laeseholders of agricultural land.

This Regional Law regulates relations in the sphere of elaboration, composition and the modalities of realization of regional land-use planning with the consideration of sustainable development of territory, distribution of protected areas and mapping of the boundaries of agricultural land. Decision of elaboration of regional land-use planning scheme shall be made by the regional administration.

La presente Ley establece que ningún acto de disposición que implique la subdivisión actual o futura de inmuebles rurales en jurisdicción provincial podrá ser válidamente otorgado, si como consecuencia del mismo se establecen parcelas o remanentes cuyas superficies no constituyen unidades económicas agrarias. La Ley indica los casos que quedan exceptuados de dicha prohibición. La Ley prevé la nulidad de los actos violatorios de estas disposiciones.

Regional Law No. 68-OZ “On rates of allotment of land parcels to citizens”.

This Regional Law establishes rates of allotment of public land parcels to citizens for farming, gardening, horticulture and stockbreeding as follows: (a) agricultural land for peasant farms – 200 ha; (b) for gardening, horticulture – 0,15 ha per family; (c) land for stockbreeding shall be calculated by livestock species but shall not exceed 0,50 ha. Allotment free of charge of public agricultural land to citizens that have the right to such allotment shall not exceed 0,50 ha.

The Order sets regulations on the Land Consolidation Commission’s responsibilities and composition of its 12 members elected every four years. The members (President, 2 Vice Presidents, 3 qualified assessors nominated by the Director of the Danish AgriFish Agency recommended by the Ministry of Business and Growth, 3 qualified agriculture specialists nominated by the Director of the Danish AgriFish Agency and recommended by the Danish Agriculture & Food Council, and 3 municipal members nominated by the Danish AgriFish Agency nominated by the Local Government Authorities).

Regional Law No. 11-OZ “On regulation of land relations”.

The scope of this Regional Law shall be realization of plenary powers of state bodies in the sphere of regulation of land relations. It establishes maximum land area allotted to citizens in ownership out of stock of public and municipal land as follows: (a) for farming – 200,0 ha; (b) for gardening and horticulture – 0,25 ha; (c) for stockbreeding – 2,00 ha; and (d) for suburban housing construction – 0,25 ha.

This Regional Law grants the right of free allotment of land on condition of ownership to multi-child families with three or more natural or adopted dependent children in possession of RF citizenship. The aforesaid land allotment shall be authorized once-only. Land shall be allotted for agricultural purposes (subsistence farming, gardening, agriculture or for housing construction) with dimensions of land area in accordance with rates of allotment validated by local government.

This Decree provides for the conditions and procedures for the licensing of building premises and facilities in exceptional cases on agricultural land. It is composed of 21 articles. Article 1 states that this Decree is mainly concerned with agricultural land already cultivated. The Decree prohibit the establishment of any facility or building outside of the urban boundaries, or in any areas that lack strategic planning.

Guideline No.11 dated 14.6.2011 on the methods of verification and change of the cadastral categories of agricultural land

The Guideline lays down rules of procedure for implementing changes in the cadastral categories of the agricultural land. It regulates the application process, defines the parties that are eligible for such application, and the methods applied for verification and approval of requests for changing the land categories. Attachments on “Average number of plants for area units’, ‘The verification act’ and ‘Certification on the cadastral change of the agricultural land” are also attached to it.
