This Decree consisting of 55 articles aims at regulating the agricultural land reclamation in Syria. Part I deals with the rules for the Agricultural Land Reclamation while Part II deals with the Distribution of irrigated reclaimed land. Article 1 states that the Minister of Irrigation may, in accordance with the Minister of Agriculture and Agrarian Reform and after taking the opinion of the General Union of Farmers, declare a public benefit in the reclamation of lands in any area of the Syrian Arab Republic.

Regulation 2(2) substitutes the reference to the year “2015” in regulation 1(3)(d)(ii) of the 2015 Regulations with a reference to the year “2016”. Regulation 2(3) adds the words “to the ballotter” into regulation 20(2) of the 2015 Regulations. Regulation 2(4)(b) amends Schedule 11 to the 2015 Regulations to add an additional entry concerning the result into the form of return that must be notified by the ballotter as required by section 52(3) of the Land Reform (Scotland) Act 2003.

This Notice contains in its Schedules declared customary law on guardianship, inheritance and wills. As to guardianship of women and children, certain powers and restrictions are placed un guardians regarding agricultural crops and livestock. A guardian is forbidden from selling land or permanent crops which are under his protection. As for inheritance, women are allowed to inherit except clan land. They can use clan land without selling it during their lifetime. But if there are no men in that clan, a woman can inherit this land completely.

El presente Decreto Supremo aprueba el Reglamento que establece las normas que regulan el procedimiento para la promoción de la inversión privada en proyectos de irrigación de tierras eriazas con aptitud agrícola de propiedad del Estado, conforme a lo establecido por el Decreto Legislativo Nº 994. Las tierras eriazas con aptitud agrícola son tierras no explotadas por falta o exceso de agua y los demás terrenos improductivos que sean de dominio del Estado.
