This Act regulates the carrying out of surveys of land by, appointment of, qualifications of, etc. land surveyors including Government surveyors, i.e. land surveyors who are public officers of the Ministry of Housing, Lands and Town and Country Planning.

This Act regulates the alienation, lease and use of and control over “State land”, i.e. defence lands, ‘pas géométriques’ and all lands belonging to or in possession of the State. The Minister may sell State land other than defence lands, mountain reserves which belong to the State, ‘pas géométriques’ or river reserves which belong to the State (sect. 3).

There is hereby laid down the legislative framework relevant to land expropriation, which shall be allowed only for public purposes. The Act defines with detail the procedure to be followed and provides for the compensation which is to be paid to owners.

An Act to provide for the validation of a replacement register of native lands for Nikunau. The principal object of this Act is to enable the Government to establish a Land Commission which shall undertake to compile a replacement Register of Native Lands for Nikunau which has been destroyed. Section 3 imposes certain duties on the Commission when compiling the replacement register.

This Chapter provides for certain aspects of the enforcement of a mortgage. The High Court may assess the amount due upon a mortgage whether of real or personal property, and shall render judgment for the amount awarded, and the foreclosure of the mortgage. Execution may be issued on the judgment, as ordered by the court.

This Chapter provides for certain matters relating to title in land. The owner of any land in American Samoa, not previously registered, may register his or her title thereto with the Territorial Registrar, but no title shall be registered unless the Registrar is satisfied that there is no conflicting claim thereto and unless the description clearly identifies the boundaries of the land.
