Moving Forward: Study on the Impacts of the Implementation of Order 01BB in Selected Communities in Rural Cambodia

In late June and early July 2012, more than 1,000 student volunteers were dispatched to targeted provinces across the country, accompanied by officials from the Ministry of Land Management, Urban Planning and Construction (MLMUPC), to implement Cambodian Prime Minister Hun Sen’s Order 01BB. The student volunteers were trained in basic measurement techniques, kitted out with military uniforms bearing the MLMUPC’s logo, transported by army trucks, and directed to measure land and grant land certificates to rural residents.

Under the motto “old policies - new action”, in June 2012 the Cambodian Prime Minister initiated a massive land registration campaign on untitled former forest land. Unauthorised settlers and other long- term users of these lands, including those inside Economic Land Concessions, had been considered illegal before. Those of them who are poor now receive full property title by way of donation. The campaign was planned for 12 months and targets 470,000 families on 700,000 parcels comprising a total of 1,8 Mio hectares. The campaign might be extended though into the year of 2014.

ABSTRACTED FROM THE EXECUTIVE SUMMARY: Following such collection and compilation of relevant information on issues of women’s land rights, this report begins by introducing the centrality of the issue of women’s land rights, the developments in this context, and the remaining challenges with respect to complying on Articles 14, 15 and 16 of the CEDAW on the particular issue of women’s access to land and related resources. This is followed by recommendations for various key actors who are involved in ensuring the related compliance.

Through LMAP, and subsequent LASSP, Cambodia has made impressive progress in building a functioning cadastral system over the last ten years. This process has proved complex and challenging, but since commencing, the land registration teams have successfully issued over 1.7 million land titles, a strong legal framework has been developed for the functioning of the land administration bodies and mechanism, institutions have been built and strengthened, and a dispute resolution process has been established for dealing with disputes over unregistered land.

This paper investigates the real financial consequences of investing in land with disputed tenure rights. It demonstrates that companies which ignore the issue of land tenure expose themselves to substantial, and in some cases extreme, risks. Using case study analysis, the paper connects ground-up financial thinking with empirical reality. In so doing, it makes a strong case for the need to integrate tenure-related risks more comprehensively into our financial architecture.

The rise of urbanization and development in Cambodia in recent years has led to a dramatic increase in land prices, with particularly high values for land in the capital city of Phnom Penh. Some government officials have benefited from the high price of land by unlawfully granting land title to private developers in exchange for compensation. Once these officials have granted land title to developers, they forcibly evict from the property existing residents, who mostly come from poor and marginalized communities. There is rampant corruption at every stage of the "development" process.

The Land Law of 2001 was a landmark statute intended to strengthen and protect the rights of ordinary Cambodian landholders. A land titling programme (LMAP) was initiated soon afterwards, with extensive World Bank and donor support. The land occupied by the community of Boeung Kak, in the heart of the capital was excluded from this process, despite evidence of prior residence going back decades. Instead it was classifi ed as having “unknown status” by the LMAP, as “state land” by default, and as a “development zone” by authorities.
