Fundamental Principles of Legislation of the USSR and the Union Republics on Land, 1990.

Legislation

This Act provides the general framework for principles regulating land relations in the USSR and the Union Republics. Union and autonomous Republics are to promulgate more detailed legislation within this framework. This Act excludes relations regarding mining, forestry, water and the protection of flora, fauna and the atmosphere. The Act is directed towards the creation of conditions for the rational use and protection of land, the regeneration of soil fertility, the preservation and improvement of the natural environment, and the equal development of all forms of economy.

Cette loi fixe le mode d'exploitation des terres agricoles. L'Etat est propriétaire, mais la loi consent aux collectifs agricoles un droit de jouissance cessible et perpétuel des terres. La loi décrit la nature et la composition des collectifs. Les agriculteurs acquièrent tous les droits sur ces terres, à l'exception du droit de propriété. Les collectifs doivent verser une redevance à l'Etat. Celui-ci cesse de rémunérer les travailleurs agricoles. Cette loi abroge l'ordonnance nº 68-653 du 30 décembre 1968 et les articles 858 à 866 de l'ordonnance nº 75-58 du 26 septembre 1975.

This text consists of 6 articles. Article 1 establishes the concept of precinct forests defined as the inland and marine fisheries domain and reserved for fishery productivity. Article 2 subjects the issuing of the land property in the precinct forest to the approval by the Ministry of Agriculture. The conduct of activities such as clearing, chopping, reclaiming or burning is prohibited unless prior authorization of the Ministry of Agriculture has been granted (art. 3).

La presente Ley establece el régimen jurídico de las vías pecuarias. Se entiende por vías pecuarias las rutas o itinerarios por donde discurre o ha venido discurriendo tradicionalmente el tránsito ganadero. Asimismo, las vías pecuarias podrán ser destinadas a otros usos compatibles y complementarios en términos acordes con su naturaleza y sus fines, dando prioridad al tránsito ganadero y otros usos rurales, e inspirándose en el desarrollo sostenible y el respeto al medio ambiente, al paisaje y al patrimonio natural y cultural.

The Act makes provisions for the conservation and improvement of the land and water resources. It establishes the Land Conservation Board (sect. 3) to exercise general supervision over land and water resources (sect. 5a) and to make conservation orders (sect. 7), closing orders (sect. 8) and orders to do work (sect. 9). Conservation Committees may be established to advise the Board. (23 sections)

La presente Ley deroga la Ley Nº 15.020, de 27 de noviembre de 1962, de reforma agraria (art. 1º). El artículo 2º de la presente Ley establece que la deroga no afectará la existencia del Instituto de Desarrollo Agropecuario creado por el artículo 12 de la ley derogada. El mencionado Instituto continuará rigiéndose por el DFL Nº 12 de 1963, y sus modificaciones, y por las demás leyes que le sean aplicables.

The centrepiece of the Law on Land Reform is the creation of Special Land Funds administered by local authorities, for the assignment of user rights thereon, including, in particular, lease rights, to individuals and concerns. Private ownership of land is contemplated only as a result of the disbanding of collective enterprises (art. 14), but it is the stated policy of the Republic of Tajikistan not to restore ownership of land formerly held by "ancestors" and religious institutions (art. 2.2).
