This Chapter regulates the use of Government land and defines uses for specific purposes and for specified parts of Guam. The Director with the approval of the Governor is authorized to grant permits for the use of any suitable government real property, not otherwise occupied or in use, and for any lawful purposes. Articles 2 to 5 provide for use of specific lands and the sale of such land to qualified purchasers. Article concerns a comprehensive development Master plan to be adopted for specified areas.

The law regulates legal relationships between state bodies, natural persons and legal entities in the sphere of amelioration (art. 1). This law covers the following spheres: a) land reclamation; b) amelioration activities; c) flood (and other disasters) control measures on agricultural lands; d) amelioration associations (art. 3).

El presente Decreto tiene por objeto el sistema de incentivos a aplicarse, por un lapso de 10 años, al fin de estimular la ejecución de prácticas destinadas a la recuperación de suelos degradados. Se entenderá por suelos degradados aquellos que, por la carencia de fósforo, exceso de acidez, niveles de erosión, deterioro de la cubierta vegetal o por presentar otras limitaciones físicas, químicas o estructurales para su ocupación, no pueden ser utilizados eficientemente de modo sustentable en la producción agropecuaria.

Al fin de evitar que se repitan focos de insalubridad constituidos por el inadecuado uso del guano, la presente Resolución dispone la prohibición del acopio y utilización de guano directo al suelo, en la jurisdicción que indica, salvo que el mismo haya sido sometido a compostaje u otro sistema de estabilización o manejo que impidan la reproducción y proliferación de moscas en cada una de las etapas del proceso de mejoramiento del suelo agrícola. El artículo 2º establece los particulares requisitos a ser cumplimentados por las instalaciones de estabilización de guano.

The present Act is composed of ten Sections: General provisions (sect. 1); Agency for Agricultural Properties (sect. 2); Resources of Agricultural Property of the Treasury (sect. 3); Financial management of the Agency and the Resources (sect. 4); Management of the Resources of Agricultural Property of the Treasury (sect. 5); Sale and purchase of properties (sect. 6); Permanent management (sect. 7); Tenancy and lease (sect. 8); Housing and social management (sect. 9); Final and transitional provisions (sect. 10).

The present Act, which is composed of 35 Paragraphs, has been adopted to ensure the development of agriculture and forestry by improving the area structure of farms, forests and forest lands, and by adapting borders of immovable properties to the system of water drainage, roads and terrain features. Integration applies to lands placed in one or several villages or their parts. However, it does not apply to lands where mining or industrial plants, historic or architectural monuments, sanctuaries, lands used for fishery or allocated for special purposes exist.

The Act, which is composed of ten Paragraphs, establishes that forests and forest lands belonging to self-governing authorities become State-owned property. The same applies to agricultural lands registered as planned to become forests. The transfer shall be accepted by the Minister of Forestry and by the Council of the State.

The present Regulation of the Minister of the Treasury, which is composed of 15 Paragraphs, establishes conditions and mode of entering into an agreement of properties exchange, so that farmers give their properties to the Treasury and get in return properties from the Resource of Agricultural Property of the Treasury. Mortgaged properties may not be exchanged.

Articles 5a and 23a are hereby added to Law No. 7501 on the land. Upon division of the land, the Land Commissions at the villages shall deposit the documentation on land distribution with the cadastre office of the competent district. Article 23a concerns the penalty to be applied to Land Commissions in case of violation of the criteria established by the Law for compiling documentation on land distribution.

The present Law lays down certain amendments to Law No. 7715, which amended Land Law No. 7501 on land leasing. According to the new provisions hereby established, the decision of the Municipality or Community Council adopted in accordance with article 21 of Law No. 7501 shall be executive title of final instance.

This Law defines the local government structures which shall be in charge of the protection and administration of the land. The Section on Land Administration and Protection is established at the regional level, as a delegation of the Council of Ministers (art. 3). Its functions are listed in article 12. Articles 14 to 17 lay down penalties to be applied in case of violation of measures related to physical damage, reduction of fertility and degradation.
