The present Regulation implements the Ordinance of 16 November 1994 on contributions for the protection of agricultural land. Part 1 establishes the specific competence of the various authorities and offices dealing with the subject matter. Part 2 lays down provisions relating to selected areas and, in particular, to their specific requirements, as well as provisions relating to details of application forms to claim payment, etc. The text consists of 31 articles divided into 3 Parts.

Les lots agricoles ou à vocation agricole relevant du domaine privé de l'Etat attribués avant le 20 rabii I 1386 (9 juillet 1966), sont cédés à leurs occupants réguliers selon les conditions fixées par la présente loi. Les opérations de cession auxquelles donne lieu l'application de la présente loi ne sont pas soumises aux dispositions de la loi n° 34-94 relative à la limitation du morcellement des propriétés agricoles situées à l'intérieur des périmètres d'irrigation et des périmètres de mise en valeur en bour promulguée par le dahir n° 1-95-152 du 13 rabii I 1416 (11 août 1995).

The purpose of the present Law is to ensure the rational use of soil; the creation and conservation of an efficient agriculture and forestry; and the restriction of foreign land tenure. The text consists of 37 articles divided into 5 Parts as follows: General provisions (1); Restrictions of the transfer of agricultural and forestry land (2); Foreign land tenure (3); Common provisions (4); Final penalties and transitional provisions (5).

Sont approuvés, tels qu'ils sont annexés au présent décret, les Statuts -Type des coopératives agricoles d'attributaires de lots domaniaux et/ou d'attributaires de lots constitués sur d'anciens immeubles collectifs.

La cession des lots agricoles ou à vocation agricole relevant du domaine privé de l'Etat attribués avant le 20 rabii I 1386 (9 juillet 1966) a lieu sur proposition d'une commission provinciale ou préfectorale, présidée par le gouverneur de la province ou de la préfecture. Le présent décret fixe sa composition et les modalités de son fonctionnement.

Sont approuvées les modifications annexées au présent décret, apportées aux statuts-type des coopératives agricoles d'attributaires de lots domaniaux et/ou d'attributaires de lots constitués, sur d'anciens immeubles collectifs, concernant les articles 4, 13, 15, 16, 25, 42 et 43. Sont abrogées les dispositions des articles 31 et 32 des statuts-type des coopératives agricoles d'attributaires de lots domaniaux et/ou d'attributaires de lots constitués sur d'anciens immeubles collectifs.

The present Ordinance implements the Federal Agricultural Lease Act of 4 October 1985. Farmers living in the area enjoy priority rights in case of lease of alpine pastures. Otherwise the competent authority shall advertise such a lease in the legal gazette. This Act aims at the improvement and protection of agricultural and forest resources in the Friuli-Venezia Giulia Region, particularly through the promotion of agriculture in mountain areas. The rational exploitation of land in mountain territories is among the objectives hereby pursued. The latter include private undertakings and public interventions (art. 3). Articles 6 to 10 define with detail the procedure to attain the rationalization of land (proposal of rationalization, preliminary project, final approval).

The objective of this Law is: (i) to determine the principles, the rules and the institutions relevant to the sustainable protection and improvement of agricultural land, giving particular regard to soil fertility; (ii) to harmonize rights and benefits of agricultural land ownership with the responsibilities for its sustainable use; (iii) to protect and rehabilitate agricultural land from adverse effects caused by harmful impact of climate and human factors.

This Regulation lays down provisions on the analysis of agricultural land indicators. In particular, it makes provision on the analysis to be carried out periodically, especially with respect to soil fertility data in order to select the appropriate agrotechnological measures to increase fertility. The analysis fees shall be approved by the Minister of Agriculture and Food and paid by the owner or the lawful possessor of the agricultural land.

This Regulation provides for the establishment of the institutions that shall be responsible for agricultural land protection and regulates their composition and responsibilities. The Regulation is composed of the following Chapters: (I) State Committee of Land Protection; (II) State Inspectorate of Land Protection; (III) Regional Committee of Land Protection; (IV) Regional Inspectorate of Land Protection; (V) Final Provisions.
