Loi sur les améliorations foncières.

La présente loi régit les améliorations foncières entreprises sur le territoire du canton avec le concours des pouvoirs publics. Elle s’applique aux immeubles agricoles, viticoles et forestiers, selon le régime propre à chacun d’eux. Le remembrement des terrains à bâtir est régi par la loi sur l’aménagement du territoire et les constructions.

Loi d'application de la loi fédérale sur le bail à ferme agricole.

La présente loi met en exécution la loi fédérale du 4 octobre 1985 sur le bail à ferme agricole. L’article 1 établit que la loi fédérale s'applique au bail à ferme agricole portant sur: a) les immeubles affectés à l'agriculture; b) les entreprises agricoles; c) les entreprises accessoires non agricoles mais formant une unité économique avec une entreprise agricole; et les immeubles de peu d'étendue Ne sont pas soumis à la loi fédérale: a) les vignes de moins de 15 ares; b) d'autres immeubles agricoles non bâtis de moins de 25 ares.

Loi d'application de la loi fédérale sur le droit foncier rural.

La présente loi met en exécution la loi fédérale du 4 octobre 1991 sur le droit foncier rural. L’article 7 établit que tout morcellement d'immeubles situés en zone agricole qui a pour effet de créer des parcelles d'une superficie inférieure à 25 ares est interdit. Cette surface est réduite à 15 ares pour les parcelles incorporées dans le cadastre viticole.(1) Des autorisations exceptionnelles peuvent toutefois être accordées par l'autorité compétente pour justes motifs, au sens des articles 59 et 60 de la loi fédérale, et si aucun intérêt prépondérant de l'agriculture n'est lésé.

Land Use Planning Ordinance.

The present Ordinance implements the Federal Land Use Planning Act of 22 June 1979. In particular, the Ordinance regulates land use planning in the Canton of Glarus dealing with the following aspects: agricultural zones, protected water areas, areas liable to natural disasters, infrastructural measures, building outside permitted areas, local authorities with no official building areas, cantonal competent authorities, and financial contributions by the Canton and dispute settlements. The text consists of 10 articles.

Ordinance on quality and harmonization of ecological measures pertaining to plots of lands.

The present Ordinance lays down provisions relating to the granting of financial contributions for the conservation of natural flora in the Canton of Appenzell Inner-Rhoden and establishes measures relating to biological qualities of plots of land. The Agriculture and Forestry Office is charged with the implementation of the present Ordinance. The text consists of 11 articles divided into 4 Parts as follows: General provisions (I); Biological quality and harmonization of ecological measures pertaining to plots of land (II); Subsidies (III); Final provisions (IV).

Implementing Regulation relating to the Federal Agricultural Soil Act.

The present Regulation implements the Federal Act on land law and land rights of 21 December 2004. In particular, it lays down provisions relating to land rights in the Canton of Obwalden. Furthermore, it establishes a Land Right Commission (Bodenrechtskommission).The said Commission shall, inter alias, survey subdivisions of agricultural land and registrations in the cadastre. The text consists of 5 articles.

Law on improvement of soil and agricultural buildings (Soil Improvement Law).

Article 1 of the present Act establishes, that, in particular, forestry and agriculture shall benefit from soil improvement measures. Soil improvement shall be carried out with a view to land use planning, as well as to protect nature, landscape, cultural heritage, waters and the environment in general. Townships are created wholly or partly within any Tribal Territory as defined in the Tribal Territories Act or within the limits of farms known as the Barolong Farms.

Ordinance on contributions for protection of agricultural land.

The purpose of the present Ordinance is to protect and conserve valuable living space and landscape through compliance of ecological requirements in agriculture. In particular, it regulates the financial contributions of the Canton to attain such results. The cultivation, maintenance and use of certain areas shall maintain their characteristic plants. According to article 12 the amount of contributions depends on various factors thereby envisaged. Part 5 deals with details of contracts made for particular cultivations.
