Securing Land Rights for All through Fit-for-Purpose Land Administration Approach: The Case of Nepal

Journal Articles & Books
June, 2021
Nepal

After the political change in Nepal of 1951, leapfrog land policy improvements have been recorded, however, the land reform initiatives have been short of full success. Despite a land administration system based on cadaster and land registries in place, 25% of the arable land with an estimated 10 million spatial units on the ground are informally occupied and are off-register. Recently, a strong political will has emerged to ensure land rights for all.

A lack of capacity in the land management and administration is a key reason that land policies are not effectively implemented in many countries and, indeed, is a reason that those policies are inappropriate or become outdated. This Guide outlines a process for assessing the capacity of the land management and administration system in a country as a whole, or just part of it (for example, just the land-valuation system, or the land management and administration system of a particular local authority).

Fraud and corruption are the main enabling mechanisms for land abuses in Brazil, guaranteeing impunity for land grabbers and other public and private agents involved in these schemes. This is what is evidenced in the research report, “Weak land governance, fraud and corruption: fertile ground for land grabbing,” which systematizes for the first time the relationship between these issues. Thereby, the study seeks to understand precisely why and how corruption and fraud associated with land grabbing occur.

India

India is one of the fastest growing economies in the world, but its growth potential can be further enhanced by improving the land governance system in the country. The manual system of maintenance and updation of land records practiced earlier resulted in poor and outdated land records. As a result, nearly two-thirds of all pending cases in Indian courts were related to property disputes. Millions of Indians could not use their principal asset as collateral to borrow from the former financial system. The poor suffer the most. A large proportion of government land lied unused.
