This Regional Law sets forth the modalities of allotment of plots of land in ownership to citizens free of charge for gardening, horticulture, subsistence farming, family farming and commercial farming, to citizens with three children under age, citizens with disabled children and specialists in agricultural professions with university degree under age of 35 years working in rural areas. It establishes also minimum and maximum agricultural land area of plots of land that can be allotted in ownership free of charge.

The purpose of this Act is to regulate provisions regarding transfer of lands to individuals in order to make efficient use of water and fertile soil, as well as leading the country to self-sufficiency. In particular, it should be noted that rights of the people on fruitful lands should be respected. Exploitation of the natural woods and forests are exclusive rights of the Government. The Government may assign abandoned lands to individuals for agricultural purpose. Indigenous people and persons with knowledge in agriculture are considered as a priority.

Article 4 shall be amended to add the following wording: “Maximum agricultural land area within the boundaries of a single municipal district, except for districts specified hereinafter, that can pertain to ownership of a single natural or legal person shall not exceed 10 percent of total available agricultural land area located on the aforesaid territory at the moment of allotment or purchase of such land plots”.

This Law amends and supplements Law No. 8405 of 1998 on urban planning as regards several issues. Specifically, it amends: (1) article 22 dealing with tasks and responsibilities of urban planning units under city councils or municipalities; (2) article 38 dealing with the procedures for the issue of construction permits; (3) article 45 on examination of requests and approval by the competent municipal authorities of construction permits; (4) article 50 dealing with the approval process for submitted applications.

This Notification made by the Minister of Lands and Resettlement in terms of Section 39 of the Agricultural (Commercial) Land Reform Act, 1995, sets out number, location and description of farming units offered for allotment and provides that an application for allotment of a farming unit must be made only by veterans of the Namibian liberation struggle determined in terms of the Veterans Act, 2008 (Act No. 2 of 2008) and on the form determined by the Minister of Veterans Affairs.
