Soil protection is the state problem since correct and rational use of all types of soil, including barren soil, saline soils, swamped soil, alkali soil and aqueous soil are the main reserve of dynamic development of agriculture and of the national economy as a whole. The purpose of the present Law is to ensure the integrity of soil surface, conservation thereof and rise of soil fertility, to establish the rights and the duties of landholders, landowners and the state in the field of soil protection and setting up conditions for ecological production. The Law consists of 11 Articles.

La Autoridad Nacional de Administración de Tierras (ANATI), podrá crear, por medio de metodología convencional o por regularización masiva de tierras, parcelaciones agrarias para destinarlas a la cría directa de animales o cultivo vegetal con fines de producción de alimentos, o para la vivienda de personas o familias dedicadas a la actividad agraria.

It specifies the following: The first register is the Register of Foreign Ownership of Agricultural Land, which contains: a) information the Commissioner obtains about foreign persons’ holdings of agricultural land; and b) published statistics derived from that information. Foreign persons must give notice to the Commissioner of: a) their holdings of agricultural land as at the start of 1 July 2015; and b) later events causing agricultural land to start or cease to be held by foreign persons.

Article 72 of Land Code shall be amended to add the following wording: “Agricultural land plots of dimensions within 5 ha shall be indivisible. Agricultural land plots of dimensions over 5 ha can be split in separate land plots for the dimensions exceeding 5 ha on condition that the dimension of new separated land plots shall not be less than 5 ha”. Article 15 of Law No. 4 on management of agricultural land shall be amended to add the following wording: “Owner of agricultural land share shall have the right to sell it without payment of state duty.
